It is five o’clock on a Friday and you still have a pile of work on your desk that the boss wants done by Monday morning. It is fair to say that your weekend will not be spent in leisure. The good news is that since you have already worked your 9 to 5, Monday through Friday, you are going to be earning overtime pay. As a member of the workforce, it is important to be familiar with the laws that govern overtime pay so as not to be discriminated against or taken advantage of.
Federal Wage and Hour Law
As required by the Federal Fair Labor Standards Act, also known as the Federal Wage and Hour Law, overtime in the amount of one and one half times an employee’s regular pay rate must be paid for hours worked in excess of 40 hours in a work week. The law does not require that overtime be paid for workdays lasting longer than eight hours or on weekends or holidays.
What your Employer Cannot Do
As a general rule, employers cannot force workers to waive their entitlement to overtime pay unless they work in such exempt positions as executive, administrative, or professional jobs and are excluded from overtime consideration. Employers are also prohibited from mandating that employees accept a lower rate of pay for overtime or no overtime pay at all.
