Interview Discrimination

Job interviews are meant to give employers opportunities to judge the skills of a potential employee and how that employee would fit into the company. Insofar as they are trying to determine this, employers can ask interviewees the questions that they need to. However, interviewers cannot ask interviewees whatever questions they see fit. Laws and regulations prevent interviewers from asking certain questions during interviews. Prohibited questions include those that can be used to discriminate for or against potential employees for reasons that are not job-related.

In general, interviewers cannot ask questions about:

  • The age of an interviewee
  • Marriage and family status and life
  • Personal health
  • Sexual orientation
  • Personal disabilities
  • Ethnic origin

These questions are by no means exhaustive of those that cannot be asked during an interview. There are a variety of questions, along these lines as well as along other lines, that an interviewer cannot ask. In effect, interview questions cannot be about anything personal about a candidate. They must be related to the job and the company. Any interviewer who asks personal questions is violating the law and is likely discriminating.
